These Terms of Service ("Terms") govern your access to and use of the RaiseMyGrade application and related services (the "Service") operated by Vyabl, LLC ("Company," "we," "us," or "our"), a Texas limited liability company. By creating an account or using the Service, you agree to be bound by these Terms.
You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you are at least 13 years of age. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf. We reserve the right to terminate accounts if we have reason to believe a user is under 13.
To use the Service, you must create an account using a valid email address and password, or by authenticating through Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree to use the Service only for lawful, personal, educational purposes. You may not:
You retain ownership of the PDF documents and other materials you upload to the Service ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive license to process it solely for the purpose of generating quiz questions for your personal use. We do not claim ownership of Your Content and do not permanently store the text of your uploaded documents on our servers.
Quiz questions, answer choices, and explanations are generated by artificial intelligence based on Your Content. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or omissions. The Service is intended as a study aid and supplement, not as a definitive source of information. You should verify important information independently. We make no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated quiz content.
The Service, including its design, code, features, and branding, is owned by Vyabl, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
We strive to keep the Service available and functioning, but we do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
The Service is currently provided free of charge. We reserve the right to introduce paid features or subscription plans in the future. If we do, we will provide advance notice and any paid features will require your affirmative consent before charges apply.
You may delete your account at any time by contacting us. We may suspend or terminate your account at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately, and we may delete your account data in accordance with our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VYABL, LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF FIFTY DOLLARS ($50.00) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Vyabl, LLC and its officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) Your Content.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vyabl, LLC regarding the Service and supersede all prior agreements and understandings.
